Clutter Free Cairns – Terms of Service

These Terms of Service ("Terms") outline the agreement between you ("Client", "you") and Clutter Free Cairns ("Company", "we", "us", "our") for the provision of organisational and decluttering services. By engaging our services, you agree to the following terms and conditions:

1. Scope of Work

Clutter Free Cairns offers organisational and decluttering services, including but not limited to:

  • Home and office decluttering

  • Organisation of rooms, wardrobes, pantries, and storage areas

  • Light wipe-down or vacuum of surfaces in worked-on areas

  • Selling items on behalf of a client

Exclusions from Scope:

  • Pest management, including treatment or removal of pantry moths, cockroaches and other infestations

  • Heavy-duty cleaning (e.g. carpet cleaning, mould removal, stain removal etc)

  • Construction or repair work

  • Installation or assembly of shelves and other storage solutions

  • Removal of hazardous materials

  • Lifting and moving heavy items such as furniture

Any additional services must be discussed and agreed upon in writing prior to commencement.

2. Client Responsibilities

The Client agrees to:

  • Provide safe and reasonable access to the property

  • Be present and ensure access during agreed appointment times

  • Be contactable during session time

  • Inform Clutter Free Cairns of any health and safety risks on the premises

  • Deal with discarded/donated items over and above the included donation removal as per the package inclusions, or otherwise agreed upon

  • Respect the professional guidance provided, and retain responsibility for final decisions regarding item retention or disposal.

  • Once items are removed for disposal or donation by Clutter Free Cairns, it is at the discretion of Clutter Free Cairns’ owner and it’s subcontractors or employees as to where the items are taken/donated.

3. Payment Terms

  • A standard hourly rate or package price will be provided before work begins

  • For private bookings, a 50% payment is due to secure your booking, and the balance is due upon completion of the session, before departure.

  • For NDIS or Aged Care (Support at Home) bookings, confirmation of availability of funds and a signed service agreement is required before the session can take place

  • Accepted payment methods: cash, bank transfer, EFTPOS, PayPal.

  • Late payments may incur a fee of 10% per week overdue

4. Cancellations & Rescheduling

  • A minimum of 48 hours' notice is required for cancellations or rescheduling

  • Cancellations made with less than 48 hours' notice (but before the day of the session) will incur a 50% fee of the booked session time

  • No-shows or same-day cancellations will be charged 100% of the session fee

  • If a session is cancelled part-way through due to disruptions or hindrances at the client’s house which we were not advised of, and prevent our work being done, or being done in a safe manner, the same-day cancellation rate will be charged

  • Please note that if you arrive late to your session, it will still end at the originally scheduled time

  • Exceptions to the above may be considered for emergencies, on a case-by-case basis

  • Any outstanding fees must be paid before further sessions can be booked

5. Liability

  • We take reasonable care in handling all belongings, but are not liable for accidental loss or damage

  • The Client understands and accepts full responsibility for all decisions regarding the retention, donation, or disposal of items. In cases where the Client authorises Clutter Free Cairns to make these decisions on their behalf, the ultimate responsibility for those choices remains with the Client

  • We recommend Clients insure valuable items and possessions independently

6. Confidentiality

Clutter Free Cairns respects your privacy and maintains strict confidentiality.

We will not disclose any identifiable personal, household, or business information obtained during service delivery unless required by law or with your written consent.

7. Third-Party Recommendations

Occasionally, we may recommend third-party services (e.g., rubbish removal, auctioneers, storage services, cleaners etc).

These are referrals only. We are not responsible for the actions, reliability, or results of third-party providers, and any agreements entered into with them are independent of our services.

8. Health & Safety

For the safety of both parties:

  • We reserve the right to decline or cease work if an environment is deemed unsafe or unhygienic. The same day cancellation rate will apply in this case.

  • Clients must notify us of pets, allergies, or hazards before the session

  • For safety reasons, pets and children must be kept clear of the work area during sessions, as the work environment may pose potential hazards

  • If pets or children are present upon our arrival, we will endeavour to work around them, but do not accept any liability arising from accidents or damage due to their presence. We may also request them to be looked after in another area of the house if their presence is hindering progress of the session. If they are not removed when requested and the session progress continues to be hindered, we reserve the right to leave, and charge the rate of a same day cancellation.

9. Amendments

We may update these Terms from time to time. The latest version will always be available upon request or via our website.

10. Media Policy

We may take before and after photographs or short videos of spaces for use in our portfolio, social media, website, or promotional materials.

  • We will not include any identifying information (faces, addresses, personal documents, etc.) without explicit consent

  • You may opt out at any time by informing us in writing

We respect your privacy and understand that some clients prefer discretion. Your comfort always comes first.

11. Selling on behalf of Clients

Where requested, Clutter Free Cairns can assist with the sale of suitable household items. This service may include photographing items, preparing listings, responding to buyer enquiries, negotiating sales, coordinating inspections and collections, collecting payments, and managing the overall sales process on behalf of the client.

Items are sold on an "as is, where is" basis. Buyers are responsible for inspecting the item and determining its suitability prior to purchase. Collection is to be arranged by the buyer from the client’s address, and the buyer is responsible for all loading, transportation and removal of the item.

A commission applies to items sold to compensate for the additional time involved in marketing and coordinating the sale of items.

Commission rates are as follows:

• 50% of the sale price for items sold for less than $100

• 30% of the sale price for items sold between $100 and $500

• 20% of the sale price for items sold for more than $500

Commission is calculated on the final sale price of the item. Any third-party selling fees, advertising costs, auction fees or other agreed expenses incurred in the sale process may be deducted from the sale proceeds before commission is calculated.

Clutter Free Cairns reserves the right to decline the sale of items that are unlikely to sell, are not economically viable to market, or present safety, legal or logistical concerns.

The client acknowledges that Clutter Free Cairns cannot guarantee that any item will sell, achieve a particular sale price, or be sold within a specific timeframe.

Where items may have significant monetary value, Clutter Free Cairns may recommend referral to a qualified valuer or auctioneer to ensure the estate receives appropriate advice regarding the item's potential market value.

The net sale proceeds, after deduction of the applicable commission and any agreed expenses, will be credited against the final invoice issued by Clutter Free Cairns. Where the value of the net sale proceeds exceeds the amount owing on the final invoice, the remaining balance will be paid to the client or authorised estate representative.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms will be subject to the jurisdiction of the courts of Queensland.
